Reports: North Korea test fires short-range missiles

SEOUL, South Korea - North Korea fired two short-range missiles off its west coast on Thursday believed to be part of a test to upgrade capabilities, said news reports published on Friday, quoting South Korean military officials.
North Korea has raised tensions in recent weeks by announcing it would launch a rocket to put a satellite into orbit, but regional powers are urging Pyongyang to drop the plan, saying it would violate U.N. Security Council resolutions.
North Korea launched two short-range missiles believed to be surface-to-ship missiles from its west coast Thursday morning, South Korea's Chosun Ilbo newspaper quoted government officials as saying.
"The launch is believed to be to upgrade missile capabilities and not related directly to the North's long-range missile launch," the newspaper quoted a military official as saying.
Another mainstream newspaper JoongAng Ilbo published a similar report.
South Korea's office of the Joint Chiefs of Staff declined to confirm the reports, citing its policy of not speaking publicly on matters involving intelligence activities.
Reclusive North Korea has said it is merely sending a weather satellite into space, but South Korea and the United States say it is a disguised ballistic missile test.
The secretive North has twice tested a nuclear device, but experts doubt whether it yet has the ability to miniaturize an atomic bomb to fit inside a warhead.
The North has said the launch would take place between April 12 and 16. The planned launch, which has even drawn criticism from ally China, will mark the 100th birth anniversary of state founder Kim Il-sung.

Game on! Supreme Court hears health care reform arguments ...
If the court strikes down the ACA, expect the employer-provided health insurance landscape to remain largely as it has for the last 50 years. If the court affirms it, the ACA?s ambitious timetable for revamping the nation?s health insurance system will continue.
The ACA was challenged four times last year in federal appeals courts. Two panels said the law passes constitutional muster. One said it was too soon to decide the question. A fourth ruled parts of the law unconstitutional.
The Supreme Court agreed to hear the government?s appeal of the last case, an August 2011 decision by the 11th Circuit Court of Appeals in Atlanta. That case was originally filed by attorneys general from 26 states.
This week, the Justices are hearing arguments on four questions from the 11th Circuit case:
1. Is it premature for the Supreme Court to even consider the constitutionality of the Affordable Care Act? This was the topic of the first of three days of arguments. Some critics of the law ? which requires almost everyone to have health insurance ? contend that the penalty for noncompliance amounts to a tax. If the Supreme Court agrees, then it could rule that the ACA?s constitutionality cannot be decided until someone has to pay the tax in 2015. Listen to an audio recording of the oral arguments here.
2. Does Congress have the authority to require individuals to purchase health insurance?the so-called individual mandate? Under the ACA, those who don?t have at least minimal coverage by 2014 would be required to pay a penalty on their 2015 federal income tax returns. 3. If the Supreme Court decides that the individual mandate is unconstitutional, can the rest of the law stand? The government concedes that many of the ACA?s provisions, such as requiring insurance companies to cover everyone, will not be financially feasible unless everyone actually has insurance. 4. Is it unconstitutional for Congress to require states to expand (and pay for) Medicaid health coverage for those too poor to afford it on their own? The ACA requires states to offer Medicaid coverage to individuals and families with incomes equal to or less than 133% of the federal poverty level.
Not on the Supreme Court?s docket: The validity of ACA provisions that would force large private-sector employers and government employers to provide health insurance benefits to employees by 2014. That ?pay or play? mandate would require employers with 50 or more employees to provide affordable bare-bones health coverage to full-time employees or else pay a penalty.

The U.S. attorney's office in Sacramento filed the new charges in federal court late Tuesday, providing the most detailed account to date in a case that has left some Democratic candidates scrambling for campaign cash in an election year.
Such filings typically are a prelude to a plea deal, but prosecutors would not confirm such a development or offer any further details.
Durkee, who heads Durkee & Associates in Burbank, was arrested in September and charged with suspicion of mail fraud after millions of dollars disappeared from the campaign accounts of U.S. Sen. Dianne Feinstein, other Democratic members of Congress and several state lawmakers.

PM pledges inquiry on cash for access claim
LONDON (Reuters) - Prime Minister David Cameron pledged on Sunday to investigate why a senior Conservative party fundraiser offered exclusive access to him in return for donations of 250,000 pounds a year.
Cameron said the actions of co-treasurer Peter Cruddas, caught on film by undercover reporters, had been "completely unacceptable", as he sought to limit the damage to his centre-right party.
Cruddas resigned soon after the Sunday Times newspaper published video of him telling journalists posing as international financiers that the contributions would enable them to have input into public policy and ask Cameron "practically any question you want".
The affair threatens to undo Cameron's efforts to shake off his party's image of being too close to the interests of business and the rich as Britain undergoes an austerity programme to cut its budget deficit.
"This is not the way that we raise money in the Conservative party, it should not have happened," said Cameron. "I will make sure that there is a proper party inquiry to make sure this can't happen again."
The disclosures capped a torrid week for the Conservative-led coalition government after a backlash over a budget that cut tax rates for top earners while freezing tax allowances for pensioners.
While there were also tax cuts for lower earners, the budget went down badly with many Britons, giving the impression the government was looking after the wealthy and cared little for those suffering rising unemployment and falling incomes as the economy struggles to recover from recession.
The funding issue is embarrassing for Cameron, who promised before coming to power in May 2010 to curb corporate lobbying, saying it was the "next big scandal waiting to happen".
The revelations were "utterly disgraceful", Treasury Minister Danny Alexander, a senior member of Cameron's Liberal Democrat coalition partners, told BBC TV.
The opposition Labour party called for an independent inquiry into what access had been sought and obtained, and demanded Cameron make a statement about the affair to parliament.
"It can't just be an internal Conservative party investigation sweeping it under the carpet," said Labour leader Ed Miliband.
"This is very serious for our democracy because we need to have the highest standards in our public life. And what we have seen today falls way below the standards that British people have a right to expect," Miliband added.
The disclosures will add urgency to talks between all three main parties in coming weeks on reform of political funding.
Previous reform attempts have foundered on the Conservatives' reluctance to cap donations from wealthy individuals and Labour's desire to avoid limits on contributions from unions.

The Sunday Times reporters had posed as Liechtenstein-based fund managers who wanted to develop contacts with Cameron and other ministers on behalf of their Middle East investors.
Cruddas told them the access would be "awesome for your business", adding some of the party's bigger donors had enjoyed dinner with Cameron and his wife Samantha in their private apartment at his Number 10 Downing Street office.
He advised them that a donation of 100,000 pounds was a minimum but that 200,000 or 250,000 pounds was "premier league".
With that kind of funding "things will open up for you", he said. "You do really pick up a lot of information."
When they met Cameron, he said, "within that room, everything is confidential and you will be able to ask him practically any question that you want".
He suggested they could even influence party policy, saying: "If you are unhappy about something, we will listen to you and we will put it into the policy committee at Number 10."
The paper reported Cruddas as saying he was sure there were "ways to work around it" when told by the undercover reporters that the money came from a foreign wealth fund. Foreign donations are banned under British election law. He suggested they establish a subsidiary company in Britain, the paper said.
Conservative party deputy chairman Michael Fallon said Cruddas had only been recently in the post and had been boasting.
"No donation was actually formally offered, no donation was accepted and it certainly wouldn't have been accepted on that kind of basis," Fallon told Sky TV.
"I need to get you off this idea that anybody can give money to the Conservative party and start dictating policy. That doesn't happen," he said.
In a resignation statement, Cruddas, founder and executive chairman of London spread betting firm CMC Markets, said he had not consulted any politicians or senior party officials before meeting the bogus financiers and denied that donors would have been able to influence policy or gain undue access to politicians.
"I deeply regret any impression of impropriety arising from my bluster in that conversation," said Cruddas, himself a major donor to the Conservative Party.
"Specifically, it was categorically not the case that I could offer, or that David Cameron would consider, any access as a result of a donation," he said.
"But in order to make that clear beyond doubt, I have regrettably decided to resign with immediate effect."

Dan Walters: Lawmakers ready to green-light California high-speed rail
Its popularity has declined sharply, many of its details have yet to emerge, and independent authorities have questioned its financial and operational viability, but California's bullet train project is very likely to get the green light from the Legislature soon.
That's the consensus of those who have been counting votes among the Legislature's dominant Democrats, who can give the California High-Speed Rail Authority authorization to sell bonds and begin construction of an initial segment in the San Joaquin Valley.
And that's true even though lawmakers still don't know, in any detail, what linking the northern and southern halves of the state via rail would entail.

Gov. Jerry Brown assumed political control of the CHSRA last year when the project appeared doomed and appointed a trusted adviser, Dan Richard, to make it work. He and other bullet train overseers unveiled, with great ceremony, a revised plan they said was workable.
However, the new price tag, around $100 billion, was several times more than what voters said it would cost when they approved a $9.95 billion bond issue, and was catnip for the project's opponents, an eclectic lot that includes San Joaquin Valley farmers, residents of the tony San Francisco Peninsula and Republican conservatives.
The sticker shock sent Richard back to the drawing board, and he's now generating a new plan that reverses the last plan's stretched-out construction schedule in favor of quicker construction. It also will attempt to grease the political wheels by offering money to Southern California and the San Francisco Bay Area for commuter rail upgrades that would accompany the San Joaquin Valley segment.
While it awaits the new revisions, a "peer review group" of transportation experts, appointed by legislators to give independent advice on the project, issued its seventh report this week, reiterating qualms about financing, ridership and other issues that "can and should be addressed before the state borrows money or the authority commences construction."
It finds the "lack of committed financing" to be especially troublesome and implies that it would be foolhardy to spend billions on the San Joaquin segment without a viable financing plan for the entire system.
The Legislature often ignores good advice from its own experts ? the bollixed-up budget being one consequence ? and makes decisions for expedient political reasons. This may be another sorry example.
Just because a bullet train sounds neato-keen or China has one are not sufficient reasons to saddle this already insolvent state with another burden it can't afford.

Your Business Decision S-Corp Vs Llc | The Plan Is To Blog
When setting up a new business, arm yourself with all the facts before deciding what form of entity to choose. Because, whichever entity you choose for your business will have financial, legal and tax implications.
Business owners often narrow their choices down to an S-Corporation or an LLC. The S-Corporation is a single that files an S-Election for tax treatment purposes. The S-Corporation is initially less expensive to form, given that there is no publication requirement; a requirement to publish a notice of formation in two newspapers over 6 weeks. The annual franchise tax is based upon wages paid, from a minimum tax of $100 to maximum of $10,000. The S-Corporation files a separate tax return and this may increase accounting costs towards the company.
An LLC is far more expensive to initially file given that there can be a publication requirement. The cost to publish can add $350-$450 for the costs of formation. In addition, similar to Franchise Tax, LLCs are required to pay annual filing fees. Beginning in 2008 the amount from the annual filing fee for 1 member LLC was reduced from $100 to $25. For LLCs that are treated as partnerships for tax purposes the annual filing fees are now based upon the LLC?s gross income ranging from $25 if the LLC?s gross income was less than $100,000, to $4,500.00 for LLC?s whose gross income was over $25,000.000.
One tax benefit for a single-member LLC is that the company can be a disregarded entity for tax purposes, so the process from the business is reported on the member?s income tax return. For an individual, the income would usually be reported on Schedule C or Schedule E of Form 1040. An LLC with far more than a single member is typically taxed as a partnership, even so, and a separate income tax return is typically required.
Some basic legal differences also exist between the formation from the S-Corporation and the LLC.
The S-Corporation provides personal liability protection for its owners. Owners are generally known as shareholders and they?re issued stock certificates. Shareholders elect directors, and they, in turn elect officers. By-laws and the business corporation law govern the entity. No foreign citizens or entities can be shareholders and no corporations or LLC?s can be shareholders. There can be a limit to how numerous shareholders are permitted in an S-Corporation. The business corporation law is restrictive and provides shareholders with certain rights.
The LLC also provides an owner with personal liability protection. Owners are generally known as ???members? and are ???interest? holders. They can be issued membership certificates or designated a percentage of membership interest. There is no limit for the number of members in an LLC. Any entity is actually a member and you will discover no restrictions on foreign members.
An operating agreement and the limited liability law governs the entity. The limited liability company law is not as comprehensive as the business corporation law allowing the operating agreement to have significant control over the members and their business relationships.
Unequal distributions can be developed to members and special allocations can be developed. Furthermore, a non-equity owner may be given total voting and management control from the LLC.
It?s critical to understand the tax implications in those two corporate entities the income of both entity passes through for the individual owners, whether an LLC or S-Corp, but in an LLC where the owner is an active participant from the trade or business, all from the income is subject to self-employment tax.
In an S-Corporation, Social Security and Medicare taxes (self-employment tax) are only paid on wages received in the S-corporation. Each entity has the ability to distribute assets for the owners as a tax-free return of capital, but in an S-Corporation, the owners must be careful of disguising compensation from the form of tax-free distributions, thereby avoiding the self-employment tax altogether.
If the owners in an LLC elect to become treated as a partnership for tax purposes and guarantee any debt from the LLC, this guaranteed debt adds to theirbasis from the partnership. In an S-Corporation, personal guarantees do not increase your basis.
In an S-Corporation, certain events may trigger the revocation from the S-election. If this happens, the corporation would be treated as a normal C-Corporation and numerous from the tax-related benefits from the S-Corp election would be eliminated. An LLC is treated as a partnership unless it elects to become treated otherwise, so there is no concern about revocation of elections.
An LLC is far more advantageous if the LLC owns assets such as real estate that are expected to appreciate in value. The LLC has the ability to distribute out the asset to an owner and the owner takes the carryover basis from the property. Sony shows a new Android-powered set-top box in Singapore
Sony has shown off a new Television set-top box at the Bravia event in Singapore, and it runs Android -- Google TV version two specifically. Beyond that, we don't know much more about the unit, but that won't stop us from looking at the pictures for clues about features.
We see some really interesting things on the remote. The first is that it appears to be a track pad, probably the same one that was demonstrated at CES. If so, that's twice we've seen it from Sony, and we imagine it will become the standard. We're loving that idea. We also can see record and DVR buttons, which may mean internal storage on the unit itself for video recording. Then there's the 3D button, that may mean 3D is on-board the box itself. Flip the remote over and you have a 61-button keypad that looks pretty functional (and busy).
What we can't guess about is an availability date or a price. All the features in the world won't help it if consumers buy the $100 solutions from Boxee or Roku. As soon as Sony says something official, we may have those answers. We're ready for a successor to the Logitech Revue, and this one has our interest piqued. Hit the break for two more pictures

In 2008, well-known Victoria wine pro Glenn Barlow opened the doors of his shop, Cook Street Village Liquor. Sister store to the Cadboro Bay shop BC Wineguys VQA Wine Store, Cook Street Village Liquor specializes in spec wines (not sold in Government Liquor Stores) and unusual beers and spirits from around the world, with an emphasis on ?value wine under $30.?

The store has proved a labour of love for Barlow, who spent five years immersed in red-tape, jumping through hoops with developers before securing his discreet (not his first choice, he?d like to add) shop in the back corner of the new residential/commercial complex in the 200 block of Cook Street. Still, Barlow makes the most of his 700 square foot store, stocking over 1000 different wines, beers, and spirits. A veteran of the Vancouver Island food and beverage scene, Barlow has worked with a variety of high profile restaurants and industry professionals, developing wine programs and fostering community among his colleagues.

If you don?t dine out often, you may not recognize many of the labels on offer at Cook St. Village Liquor. That?s because over 80% of their stock is unavailable at government stores, often sourced from agents of obscure international wines. Rather than grouping wines by region, the stock is laid out according to varietal, with exceptions for distinct regions of the world with telltale styles such as Italy, Spain and France. The wine stock is heavy on the reds (reflecting demand), though they do have a well-represented white selection, mainly chilled in the refrigerators. As well, the constantly-revolving beer lineup changes with the seasons to complement the tastes of the neighbourhood customers and the employee feedback from the weekly staff tastings.

Director Kevin Smith dishes advice in new memoir
NEW YORK (Reuters) - Kevin Smith says he has learned a lot of tough lessons in the two decades since breaking into the film industry with his indie hit "Clerks," and now he wants to pass them on.
"Tough Sh*t: Life Advice From a Fat, Lazy Slob Who Did Good," Smith's fourth book, hits the shelves on Tuesday in the United States. In it, Smith focuses mainly on the highs and lows of the last five years of his career. He also talks about why he intends to retire from directing movies and other future plans.
"Film is one of the only art forms where you're like, 'I want to express something, give me $20 million and Ben Affleck in order to do it.' I've done that," he told Reuters.
Smith, 41, made "Clerks" for under $30,000 at the local convenience store where he worked. The movie went on to win awards, was acquired for distribution by Miramax Films and pulled in over $3 million in theaters.
Since then, the New Jersey-born Smith has written and directed films including "Dogma," "Chasing Amy," and "Zach and Miri Make a Porno." Some were critically acclaimed, while others, like "Mall Rats," and "Jersey Girl," were panned.
He vowed he is working on only one more live-action feature: "Hit Somebody," a story that follows the life of a Canadian hockey player from 1950 to 1980. After that, he plans to focus mainly on podcasting and his Internet radio station, SModcast.
"Podcasting is the democratization of entertainment. It really blurs the line between the entertainer and the entertained," he said.
Smith has built a large online following, and 'Tough Sh*t' started as a number of tweet responses to questions from some of his more than 2 million Twitter followers, which he began compiling on his "Silent Bob Speaks" website named after one of his more famous characters.
The end result is what Smith calls "part memoir, part advice to me."
"If you like me, I'm a good role model, and maybe you want to do the stuff I've done. But if you don't like me, you use that as fuel too, and you say, 'If this fat chump can do it, I should be even more successful,'" he said.
The book covers a wide range of topics from Smith's difficulties directing Bruce Willis in the buddy flick "Cop Out" to his veneration of hockey great Wayne Gretzky to drug use and his 2010 public feud with Southwest Airlines.
Smith labeled the incident with the low-cost U.S. airline, in which he said he was ejected from a flight for being too big for his seat even though he could buckle his safety belt and put his arm rests down, one of the lowest points of his life.
After he was escorted off the plane, he unleashed a barrage of complaints about his treatment on Twitter and Southwest eventually apologized. But not before the press picked up on Smith's "too fat to fly" tweets.
"You had about 5,000 news articles on Google based on the tweet that I wrote, using my own words against me. That was hands down the low point," he said.
These days, he is keeping busy taking his comedy podcasts on the road for live shows and promoting the work of young independent filmmakers.
He also has an animated "Jay and Silent Bob" film in the works, and an unscripted TV show called "Comic Book Men" filmed inside of Smith's New Jersey-based comic shop. The TV program wrapped up its first season on the AMC network on Sunday.
"If you could figure out how to monetize passion, and that's pretty much what I do, then you've got your handle on something. Basically, I just kind of speak passionately about the stuff that I dig, and that creates content," he said.
